A Jan. 3 hearing date has been set for the attempted grand larceny and burglary case against Jaime Bustamonte.

Lyon County Assistant District Attorney John Schlegelmilch said Tuesday that he will be prosecuting the case against Bustamonte.

Schlegelmilch was asked to take on the case after Carson City District Attorney Noel Waters said his office had a conflict of interest because both his office and Bustamonte are named in a successful petition drive for a grand jury.

Fewer than 12 hours after a motion to dismiss the charges was filed by the district attorney's office on Dec. 18, Bustamonte was arrested in a burglary.

Both cases will be heard at Carson City Justice Court.
