The state has asked a judge for permission to fire a female guard who admitted performing a sex act with a male officer while on duty.
Amie Bianchini was fired after admitting she performed oral sex on a male guard while the two were working at Lovelock Prison in February 2005. But she was reinstated by hearing officer Pat Dolan who ruled the conduct disgraceful but didn't warrant firing her.
Prison officials petitioned Carson District Court to reverse that decision and let them fire Bianchini.
The attorney general's office has filed a motion for summary judgment in the case saying Bianchini "has totally and utterly failed to participate in this appeal."
The motion says she failed to file the notice of her intent to participate in the appeal and hasn't replied to any of the state's filings in the case.
Bianchini and the male officer, Sean Hoferer, both admitted she performed oral sex on him in a bathroom while the two were working a night shift.
He resigned, but she contested her firing.
Director of Corrections Glen Whorton said that conduct can't be tolerated.
