The Nevada Supreme Court has announced the opinions settling which
questions will be on the November ballot will be issued Friday.
The court Aug. 23 heard arguments on three statewide questions
including the Tax and Spending Control initiative.
TASC was challenged by union representatives who oppose it on grounds
supporters filed one version of the proposed amendment with the
Secretary of State but circulated a different version. Opponents also
argued it involved more than one subject, violating the mandate ballot
questions deal with just one issue.
In addition, the court heard arguments on the proposed amendment to
limit governmental powers of condemnation " a property owner's bill of
rights " and the question asking voters to ban smoking in almost all
public places.
The fourth issue under submission to the court is a Boulder City
initiative that would essentially prohibit development of about 100,000
acres of land in that community.
County clerks have been waiting anxiously for decisions from the court
because they can't order absentee, mail in and sample ballots until
they know whether those questions are on the Nov. 7 ballot.
