FRESNO, Calif. " A Modesto man will spend 78 months in prison after making racist threats over a CB radio in what prosecutors say was an attempt to drive a black man out of his neighborhood.

Bradley Smith, 25, was sentenced Friday in U.S. District Court for what was classified as a bias-motivated crime.

Prosecutors say Smith, found guilty in May, began threatening the victim after the man moved to Smith's neighborhood in 2005.

Other CB enthusiasts testified that they heard Smith threaten to burn a cross in the victim's yard, hang the victim from a tree and sexually assault the man's wife.

The Civil Rights Division has charged 191 defendants in 129 cases with bias-motivated crimes since 2001.
