RENO " A family court judge handling the divorce case of Gov. Jim Gibbons has ruled that the Nevada statute keeping the case under seal is unconstitutional.
Judge Francis Dougherty on Friday set a 60-day period for arguments over what portions of the divorce case should remain sealed.
The case had been sealed last year at Gibbons' request, but his wife's attorney Cal Dunlap moved over the summer to have the case unsealed.
Dunlap argues that the governor violated an agreement to not speak publicly about the case by giving an interview about the divorce.
Gibbons' attorney, Gary Silverman, said he would confer with the governor to decide whether they would appeal the ruling to the Supreme Court of Nevada.
The governor filed for divorce in May, citing incompatibility.
