CARSON CITY, Nev. (AP) - A state judge says he'll rule quickly on whether Tea Party of Nevada candidate Scott Ashjian will be allowed to remain on the November ballot as a U.S. Senate candidate.
District Judge James Russell in Carson City heard arguments Wednesday on a petition by Independent American Party candidate Tim Fasano, who argues Ashjian should be removed because he filed his candidacy papers before changing his voter registration from Republican to the minor party.
But Ashjian's lawyer countered that the time lapse of less than a day from when the candidacy and voter registration documents were filed is minor and not enough to remove Ashjian from the ballot.
