(AP) - Nevada will receive $425,000 from Dannon Co. Inc. as part of a multistate settlement in a lawsuit alleging it made unsubstantiated marketing claims about its Activia and DanActive products.
The company in its advertising claimed Activia yogurt helps relieve irregularity and that its DanActive dairy drink helps people avoid catching colds or the flu. The Federal Trade Commission says there is not enough evidence to back those statements.
Nevada was among 39 states that joined in the lawsuit. Nationwide, Dannon agreed to pay $21 million.
