LAS VEGAS (AP) - Lawyers for Nevada Gov. Jim Gibbons are asking a federal judge to dismiss a lawsuit alleging Gibbons led a cover-up of allegations that he grabbed a waitress outside a Las Vegas restaurant in 2006.
Gibbons' lawyer, Pat Lundvall, says Chrissy Mazzeo acknowledged in sworn statements that she lacked evidence to support her "inflammatory and salacious" claims against Gibbons.
Mazzeo's lawyer, Robert Kossack, is due to file a response this month. He said Monday that pretrial depositions and evidence exchanges aren't done yet, but he's got proof supporting Mazzeo's claims.
Mazzeo accuses Gibbons of accosting her after a night drinking with friends in October 2006.
Gibbons was a Republican congressman at the time, campaigning for governor.
Mazzeo alleges she was retaliated against when she went public shortly before Gibbons' election.
