Calif. murder suspect caused scare at Lyon courthouse in 2008

The man who prompted the lockdown of the Yerington Courthouse two years ago was arrested by San Diego police in Reno Monday for investigation of the 1995 murder of his wife.

Russell Upton, 36, of Reno remained in Washoe County Jail on Tuesday.

Upton is suspected of killing 20-year-old Marilane Abueg of Mission Valley, Calif., in August 1995.

In April 2008, Yerington District Court was locked down after a caller reported that Upton was headed there, possibly to seek revenge after he learned no charges would be filed in the death of his cousin.

The cousin, Robert Upton, 33, died after a "mutual combat" fight in Mason Valley, according to the Lyon County Sheriff's Department.

Lyon County District Attorney Bob Auer said Tuesday that after the scare, his office bought a metal detector for the courthouse.

The metal detector is still in place, he said, but the county won't fund a position for anyone to man it.

"They've got two bailiffs sitting there, neither one will run the metal detector, we still have security problems at our courthouse," Auer said. "They should fix it before somebody gets hurt."
