(AP) - The state of Nevada has filed a motion with the Nuclear Regulatory Commission supporting the Department of Energy's application to withdraw its Yucca Mountain license application.
The petition filed Monday argues that the regulatory agency can't "second guess" an applicant's decision to withdraw.
The commission has scheduled a hearing June 3-4 in Las Vegas on the DOE's application.
In announcing its decision to pull out, the Energy Department said the Yucca Mountain repository 90 miles northwest of Las Vegas is not a workable option for high level nuclear waste disposal.
