Deputy in fatal bike wreck might be charged

RENO (AP) - The Nevada Highway Patrol is recommending criminal charges be filed against a Washoe County sheriff's deputy in a fatal accident with a 21-year-old bicyclist in July.

Deputy Matt Durham was responding to a call in a marked SUV without lights or siren when he struck Kevin Albertson of Reno on Lemmon Drive north of town.

The patrol recommends he be charged with vehicular manslaughter, failure to use due care and failure to maintain a travel lane.

A Reno newspaper first reported the recommendation after the county commission voted on Tuesday to send the case to the state attorney general to avoid any conflict of interest.

State prosecutors now will decide whether to charge Durham.
