Judge OKs battery claim trial against Gibbons

LAS VEGAS (AP) - A federal judge in Las Vegas has given the go-ahead for trial on a battery claim filed by former cocktail waitress against Nevada Gov. Jim Gibbons.

But U.S. District Court Judge Roger Hunt said plaintiff Chrissy Mazzeo can't seek damages on a separate civil emotional distress claim.

No trial date was immediately set.

Mazzeo's lawyer, Robert Kossack, said Friday she's excited to be able to take her claims against Gibbons, campaign adviser Sig Rogich and former Clark County Sheriff Bill Young to a jury.

Mazzeo now lives in California. She alleges a conspiracy to discredit her after she filed a criminal complaint against Gibbons weeks before his 2006 election.

She alleges Gibbons grabbed her in a parking garage after a night spent drinking with friends at a Las Vegas restaurant.
