McClelland gets 3-10 years in prison

A 28-year-old Fallon man with a lengthy criminal history was sentenced Tuesday in District Court up to 10 years in prison.

Kyle Wayne McClelland received consecutive sentences for one count each of fraudulent use of a debit/credit card (12-48 months) and possession of a stolen vehicle (24-60).

McClelland said he suffers from an extreme addiction to methamphetamine and said he is in need of treatment. He told Judge Tom Stockard he performed well in previous stints on parole, needed to provide for his 2-year-old daughter and did not want to be like his father.

McClelland’s father, Kenneth, was sentenced in January 2010 up to 45 years in prison for beating a man with a sledgehammer.

Kyle McClelland’s attorney, David Neidert, said his client’s history stemmed from drug use, which according to a New Frontier evaluation rates a nine on a scale of 10. Neidert asked for a concurrent sentence and request his client be afforded treatment before starting the sentence.

Stockard, though, said while he was moved by Kyle McClelland’s passionate pleas, he agreed with Churchill County Deputy District Attorney Michael Winn’s argument for consecutive sentences.

Winn rattled off McClelland’s history, which includes six felony, one gross misdemeanor and seven misdemeanor convictions. Winn said McClelland has the tools to be a productive member of society, had several opportunities to seek treatment, but opted to use drugs and commit crimes.

“He’s perfectly capable of being a productive member of society, but doesn’t want it,” Winn added.

In other court news —

Rebekah Lee Rodriguez pleaded guilty Tuesday to driving under the influence, a third offense.

Rodriguez was arrested on Sept. 1 with a blood-alcohol content of .271, more than three times the legal limit. This is her second DUI conviction this year after a Feb. 27 guilty plea.

Her sentencing hearing is scheduled for Dec. 3, although Rodriguez will apply for the DUI Diversion Program.

Kimberly Gail June received a suspended sentence of 12-34 months for possession of a controlled substance.

She was placed on five years probation.
