ELKO — A former police captain is appealing his conviction in northeast Nevada on an incest charge after he pleaded guilty last year and was sentenced in June to two years to life in state prison.
The Elko Daily Free Press reports that Aaron Hughes is arguing that investigators used an insufficient search warrant to collect evidence from his home and computer.
Elko County District Attorney Mark Torvinen argues the search warrants contained the necessary probable cause and that District Court Judge Nancy Porter properly admitted evidence in the case.
The 41-year-old Hughes is from Spring Creek.
He pleaded guilty before trial and apologized in January 2013 for having sex with a teenage girl five years earlier.
The judge rejected his lawyer’s plea for probation.
