Probation revoked for Fallon man

A Fallon man who had been placed on probation for conspiracy to sell drugs last year was sent to the Nevada State Prison on Tuesday for violating his terms of conduct.

Jesse C. Gilbert, 27, pleaded guilty in the Tenth Judicial District Court to one drug charge and was given probation on Dec. 17, 2014. At the time Gilbert faced two to five years in prison after pleading guilty to one count of conspiracy to commit a felony crime under the Uniformed Controlled Substance Act.

Gilbert was arrested May 7, 2014, after he conspired to sell methamphetamine with Savannah Lund to a confidential informant. The district attorney’s office said Lund is awaiting a hearing on a probation violation.

According to court testimony before Judge Tom Stockard, Gilbert was accused of violating a restrictive person clause and court directives in his probation. He previously failed to complete the Western Nevada Regional Drug Court. When reading a probation report in court, Stockard said Gilbert told officers he didn’t have communication with the person because his phone didn’t work, but his phone rang during questioning. Stockard said after the call Gilbert threw the phone on the ground which broke into several pieces.

Gilbert, though, said he was with his children when officers approached him.

“They were scared, so I broke it,” he said.

Public defender Peter Smith told the court that despite a violation, Gilbert showed “a great deal of improvement” during the past six months. Chief Deputy District Attorney Lane Mills, however, asked the court to revoke Gilbert’s probation. Stockard agreed and remanded Gilbert to sheriff’s custody to await transportation to the NSP.

Gilbert was given credit for serving 224 days in the Churchill County Jail.


In other court news —

Owen Eugene Dick faced Stockard for violating his probation. According to court testimony, Dick allegedly tested positive for meth on July 7 and was cited for petty theft in Washoe County on July 20. Dick denied both charges.

Woodman said Dick will appear in Washoe County in two week on the burglary charge. Stockard said he would set an evidentiary hearing after Dick appears in Washoe County.

Jordan Anthony Lopez and Nicholas Andrew Messick will report to court on Aug. 17 to begin drug court.

Lopez pleaded guilty for being under the influence of a controlled substance, marijuana, on July 7.

Messick pleaded guilty to using or being under the influence of a controlled substance, methamphetamine. He was arrested on July 18 on Sheckler Road near Lattin Road.

Stockard sentenced both men to three years probation, and they must also complete the Western Nevada Regional Drug Court. If Lopez and Messick complete the program, which is between one to three years, the felony case will be dismissed. If they fail to complete the program or violate probation, they may serve a one- to four-year prison sentence.
