Inmate receives $305,000 settlement after being shot by correctional officer

The Board of Examiners on Tuesday approved a $305,000 settlement in a case where an inmate was shot by a correctional officer.

Antonio Davis, 22, was hit in the leg, body and face with birdshot in the incident at High Desert Correctional Center in Southern Nevada. He was shot after the officer found him in a “forbidden area” and ordered him out. Davis, who was 19 at the time, reportedly refused to comply with the officer’s instructions.

Since the shooting, he has undergone two eye surgeries and has been transferred to the Northern Nevada Correctional Center in Carson City.

He sued originally asking for $900,000 in damages.

The state settled the case for $305,000 including attorney fees after being told going to trial could cost as much as $300,000 in attorney fees and other costs alone.

As part of the deal, Davis waived any ability to further sue the state.

Davis is serving 10 years for armed robbery out of Washoe County.
