Grimes Point case lands another sentence

A Fallon man with a lengthy juvenile and growing adult criminal record was sentenced Tuesday in District Court for defacing Hidden Cave at Grimes Point.

Scotti Richard Jenkins must serve 60 days in the Churchill County Jail, although his prison sentence of 19-48 months was suspended. Once he is released from jail, Jenkins will be on probation for up to five years and must pay back $12,589.72 as part of joint restitution in the case.

He pleaded guilty to one count of placing graffiti on or otherwise defacing a protected site, a felony.

Five other co-defendants have already entered guilty pleas or are awaiting sentencing for defacing the historical landmark more than one year ago.

Jenkins’ attorney, Dave Neidert, called the act stupid but said his client should be allowed a chance at full probation or serve the jail sentence on weekends so Jenkins could continue work at his job.

Jenkins told the court he would appreciate the stipulation, but never apologized for his actions.

Churchill County Chief Deputy District Attorney Lane Mills, meanwhile, said Jenkins’ history caused concern.

Mills said his juvenile record began in 2007 and grew to five arrests leading to Jenkins’ placement in China Spring Youth Camp in Minden. Those at China Spring can allowed be placed their by court order.

Mills continued as he detailed Jenkins’ history as Jenkins was arrested for assault with a deadly weapon three months after he turned 18 and also was convicted of driving under the influence.

“There are consequences for your conduct, and so far, so far, he has skated,” Mills said.

Jenkins’ suspended sentence also contains the conditions he must received a substance abuse evaluation and follow any recommendations; pay a $400 fine; cannot use any drugs or alcohol; must perform 100 hours of community service; and has his license suspended for six months.

Those conditions are mandated by state law.

The case began when officials discovered Hidden Cave was spray painted, the gate broken and urine spots found in the cave. Additionaly, other areas leading up to the cave were defaced in the incident in February 2014.

The other co-defendants include Sean O’Brien, William McHaney, Justin McGilton, Jazzmend Crabtree and one juvenile, who’s case is not subject to public record per state law. O’Brien pleaded guilty last week and will be sentenced June 2.

In other court news —

Amanda Sheree Kirkbride pleaded guilty Tuesday in District Court to one count of possession of forged sales receipt and one count of possession of a controlled substance.

According to the criminal complaint, Kirkbride was arrested after she used a fake receipt to return at least one item to Walmart and also possessed methamphetamine.

She was facing another case, which included a burglary and second forged sales receipt count, but it was dismissed as part of the plea agreement.

Kirkbride faces one to four years in prison for both charges she pleaded guilty and will be sentenced June 9. She was released on her own recognizance, but must check in daily with Court Services and submit to random testing.
