WHEREAS, Ronald Trunk is the Judgment Debtor and indebted to
COLPO CALDO, LLC, the Judgment Creditor; and
WHEREAS the amounts owed by Judgment to the Judgment Creditor
are secured by the Deed of Trust that was recorded in the Official
Records of Lyon County, Nevada, on June 15, 2005, as Document No.
353838; and
WHEREAS the United States District Court District of Nevada, Case
No. 3:18-cv-00289-LRH-WGC, has ordered that the Deed of Trust will be
foreclosed at a judicial sale pursuant to a writ of execution; and
WHEREAS the Writ of Execution issued on July 14, 2022 for the
amount necessary to satisfy the lien, which is $399,437.96, together with
the costs of sale, accrued interest and fees.
NOW, THEREFORE, in accordance with the terms under the
authority of said Orders and Writ of Execution, notice is hereby given
that on October 18, 2022, at 10:00 a.m., at the entrance to the Lyon
County Courthouse, located at 911 Harvey Way, Yerington, NV 89447,
the U.S. Marshals Service will sell at public auction to the highest bidder,
in lawful money of the United States of America, all that certain lot, piece,
or parcel of land situate in Lyon County, State of Nevada, described as
follows: See Exhibit “A”.
The minimum bid will be $399,437.96.
Said sale will be made, without covenant or warranty, express
or implied, regarding title, possession, or encumbrances, to pay the
outstanding assessments, charges, fees, and expenses of the Judgment
Creditor created by said default. Said sale will be made subject to the
statutory 60 day right of redemption set forth in NRS 116.31166 and the
one year right of redemption set forth in 28 U.S.C. § 2410(c). A deed
without warranty conveying title to the Grantee will be recorded at the
end of the aforementioned redemption period(s) if the right of redemption
is not exercised.
