Teacher to appear in court

A Carson City teacher will be arraigned next month for allegedly swatting a 9-year-old girl on the back of the head with a book.

A criminal complaint filed charges Dan Porath, 54, with one count of misdemeanor battery.

The complaint alleges that Porath, a teacher at Empire Elementary School, "did strike a minor child in the back of the head with a book or other object, causing the victim to bite her lower lip and/or gum."

According to the police report, the incident allegedly happened during classes at the East Carson City school on Dec. 18.

The girl's parents informed the school and called police on Dec. 19.

Superintendent Richard Stokes said at the time that Porath was placed on paid administrative leave pending the outcome of an investigation.

Porath, an Empire teacher for 18 years, said he did not intend to harm the girl, and that he was not aware that she had bit her lip.

He said he only tapped her to get her attention during class.

Porath will be arraigned on the charge before Justice of the Peace Robey Willis on Jan. 13.
