Nevada high court rules on citizen activist's ejection

RENO, Nev. (AP) " The Nevada Supreme Court has found that a judge erred in finding undisputed cause for a citizen activist's removal from a Washoe County commission meeting.

The high court sent the case involving Gary Schmidt back to District Judge Jerome Polaha for further proceedings.

The high court said a reasonable person could have concluded that Schmidt's removal from an Aug. 28, 2007 meeting was not merited.

Justices said Schmidt has the right to sue the entire county board and he also had the right to seek a court order.

Then-commission Chairman Robert Larkin ordered a deputy to remove a visibly upset Schmidt from the chambers as Schmidt was speaking at the podium.

Schmidt lost a race to Larkin last November.
