Benedict Stefan Leval, 26, waived a preliminary hearing Monday and is expected to plead guilty to attempted lewdness with a minor when he appears March 30 in Carson City District Court.
Leval appeared before Judge Robey Willis. He was arrested Dec. 20 as he and his 3-year-old son entered the U.S. from Canada on a Greyhound bus.
Leval was charged with suspicion of felony statutory sexual seduction and lewdness with a child under 14 for allegedly seducing the daughter of a friend in November 2007.
Investigators allege that he fled the country after detectives called him for an interview.
Attempted lewdness with a minor carries a penalty of eight to 20 years in prison.
Also on Monday, Leval's brother, Micah, 23, appeared in Carson City District Court for a probation revocation hearing. The hearing was continued for a week.
On Feb. 27, Micah Leval arrived in Carson City after being deported from Canada.
He had pleaded guilty in March 2008 to gross misdemeanor conspiracy to use a minor to produce pornography. He was sentenced to serve 60 days in jail with 10 months in jail suspended.
According to court documents, Micah Leval offered the son of a friend $500 to perform a sexual act while Leval recorded it on his cell phone.
The child told an investigator that Micah Leval said "he would sell the movie on the Internet and they would make a lot of money off it," according to the arrest report.
Micah Leval will appear in court next on Monday, where a judge will determine whether to revoke his 10-month suspended sentence.
