A Yerington man charged in a fatal January wreck will appear in court in August.
Gary Tomb, 53, was released on his own recognizance after his arrest Friday night on a warrant charging him with misdemeanor vehicular manslaughter, speeding and failure to stop at a stop sign.
According to court records, Tomb was eastbound on Highway 50 East in Silver Springs when he drove through a four-way stop at more than 60 mph.
Ryan O'Shea, 22, of Stagecoach was making a westbound turn onto the highway when Tomb's pickup struck his driver's side door, records show. O'Shea was pronounced dead at the scene.
Lyon County Deputy District Attorney Brandy Jensen said she was unable to charge Tomb with driving while impaired because toxicology results indicated that, although Tomb had a prescription pain medication in his blood, it was well under his doctor's prescribed dosage.
Because Tomb was injured in the crash, troopers couldn't administer a field sobriety test.
"Without a field sobriety test we can't prove that he was impaired," she said.
The mother of O'Shea's fiance, Krymsen Hernandez, is angry that Tomb has escaped a more serious charge.
"We are shocked and appalled that if you kill someone doing almost twice the speed limit and running a stop sign, the charge is still a misdemeanor," Rachel Hernandez said. "Six months in county jail just doesn't seem right for killing someone."
Tomb did not return a message left for him at his home Tuesday.
He will appear in Fernley Justice Court on Aug. 25.
