LAS VEGAS (AP) - Nevada's state labor administrator says a tip-pooling program instituted by Wynn Resorts Ltd. nearly four years ago does not violate Nevada law.
Commissioner Michael Tanchek on Monday dismissed claims by several Wynn Las Vegas dealers who argued they lost revenue when the resort began sharing tips with table games supervisors in August 2006.
Dealers' attorney Jay Litman promised to appeal to Clark County District Court.
The policy was also instituted at Wynn's Encore when it opened in December 2008.
Tanchek called testimony from two Wynn employees "contradictory and inconclusive."
He says the casino didn't retain tips for its own use or directly benefit due to the increased compensation for supervisors.
Dealers voted in 2008 to unionize through the Transport Workers Union of America. A collective bargaining agreement hasn't been reached.
