Court upholds injunction against Las Vegas bar

(AP) - The Nevada Supreme Court has upheld a lower court injunction issued against a Las Vegas bar for violating Nevada's Clean Indoor Air Act by allowing smoking and providing ash trays and matches to patrons.

In a ruling issued Wednesday, justices said the actions taken against Bilbo's Bar & Grill by the Southern Nevada Health District, and a lower court finding that the indoor smoking ban is constitutional, are valid.

Among other things, Bilbo's argued that the law approved by voters in 2006 and the court injunction were unconstitutional because they violated the businesses' commercial free speech right to advertise on ashtrays and matchbooks.

But justices said the burden on free speech was narrow and the injunction preserved the "significant government interest" to protect the public from secondhand smoke.
