The attorney general's office has filed a petition asking Carson District Court to rule on whether White Pine County rancher Hank Vogler can serve on two appointed boards at the same time.
Vogler was at one point appointed to and serving on three different boards ? the Board of Agriculture, Rangeland Resource Commission and Wildlife Commission. He was appointed by then-Gov. Jim Gibbons to terms ending this coming October.
But since those appointments were made, lawmakers passed a new statute that prohibits any individual from serving on more than one appointed state panel as a time.
When the new law took effect and the issue was raised, Vogler resigned form the Wildlife Commission. But he remains a member of the other two panels and the legal question becomes whether he can do so because the appointments were made before that law passed.
The petition asks the court to decide whether Vogler can serve on the two boards or not.
