Fallon man pleads innocent in child porn case

FALLON " A convicted sex offender in Fallon has pleaded not guilty to hundreds of child sex charges in Churchill County District Court.

Daniel DeWayne Green, 41, has been jailed since November on suspicion of failing to register as a sex offender, resisting an officer and a warrant from Oregon.

On Tuesday, he pleaded not guilty to one count of lewdness with a child under the age of 14, four counts of use of a minor as a subject in the production of pornography, three counts of unlawfully obtaining and using the personal identification of another to harm a person and 265 counts of possession of visual pornography of a person under 16 years of age.

Green also pleaded not guilty to the previous charges of failing to register as a sex offender and lewdness with a child.

The investigation began in November when a woman reported seeing young boys regularly visiting Green's trailer home.

Judge Leon Aberasturi said Tuesday that Green may be required to undergo a sexual-review evaluation because of the charges.

Paul Drakulich, a public defender representing Green, said he intends to file a motion to separate the lewdness case from the pornography charges.

Aberasturi asked Green during Tuesday's hearing if Drakulich had explained the charges and potential punishments. A subdued Green answered "sort of."

The judge then asked Green if the proceedings were boring him and wanted to know if the defendant was going to participate in the process.

"What part do you think I am not participating in?" Green responded. "I told you 'sort of."'

Green faces life in prison with the possibility of parole after 10 years on the lewdness count and each of the four counts of use as a minor in the production of pornography.

Obtaining and using the personal identification of another to harm a person carries a prison sentence of one to 20 years, and each of the 265 counts of possession of visual pornography of a person under 16 years of age could result in one to six years in the penitentiary.

Deputy District Attorney Craig Mingay and Drakulich informed Aberasturi the trial might last more than two weeks. The judge said if that is the case, the trial may not be able to be scheduled until 2009.

Green was classified as a sexual predator in Oregon after being convicted of attempted sodomy and kidnapping in July 1986, according to Oregon's sex offender registry.
